After a jury trial, appellant Dominick Graham was convicted of the lesser included offense of second degree murder while armed, in violation of D.C.Code §§ 22-2403, -3202 (1996). 1 He filed a timely appeal, contending that (1) the trial court should, have declared a mistrial because a juror failed to disclose until jury deliberations that he knew a government witness; (2) his motion for a new trial, based upon the recantation of a government witness, should have been granted; and (3) the trial court erred in failing to give the jury additional instructions during jury…
