MEMORANDUM and ORDER

COSTANTINO, District Judge.

Having exhausted his state remedies, petitioner applies for a writ of habeas corpus to set aside his conviction after jury trial in Suffolk County Court of the crimes of robbery in the third degree, grand larceny in the first degree and grand larceny in the second degree. Upon conviction for robbery in the third degree and grand larceny in the first degree, the petitioner was sentenced to a term of 5 to 10 years; for grand larceny in the second degree, petitioner was sentenced to a term of 2% to 5 years.
