This action was brought to foreclose a chattel mortgage executed by V. Kratz and the Clal-lam Lumber Company to Russell & Co., an Ohio corporation, to secure the payment of $3,000, the same being a part of the purchase price of certain sawmill machinery included in the mortgage. The instrument was dated May 26, 1891, but was not acknowledged and delivered until June 3, 1891.
