Reversing.
This action for assault and battery instituted by appellant, Roy Crabtree, against the appellee, John T. Dawson, grew out of the following facts: Appellee, Dawson, owns a three-story building on the corner of Main and Locust streets, in Owensboro, Ky. The room on the first floor is used as a business house. • The second floor is divided by a partition, the room on one side being used for private entertainments.
