This adversary proceeding arises out of a financing agreement between plaintiff (and debtor in this Chapter 11 bankruptcy case) 604 Columbus Avenue Realty Trust (“the Debtor”) and defendant Capitol Bank and Trust Company (“Capitol Bank” or “the Bank”). The Bank loaned the Debtor $1.5 million to purchase real property located at 604-610 Columbus Avenue in Boston, Massachusetts, and the restaurant, Bob the Chef, operated at that location, and to renovate and resell part of the real property ás condominiums.
