The above entitled civil action is before the Court on cross motions for partial summary judgment. The plaintiff and counter-defendant, Hughes Associates, Inc. (Hughes), has moved to strike the defendant’s answer and counterclaim because the defendant is a foreign corporation and not qualified to do business in Alabama and to declare a restrictive noncompetition clause in the contract between the parties void as a matter of law.
