Defendant in error, as plaintiff, brought this action before a justice of the peace to recover damages for a fire alleged to have been set out by a locomotive, through the negligence of plaintiff in error. In the bill of particulars filed by plaintiff, judgment for $299, with interest thereon from October *40228, 1891, and costs of suit, was demanded. The bill of particulars was filed December 8, 1891, and, including interest, the amount of plaintiff’s demand was $301.
