This is an appeal from the refusal of the court below to grant defendant’s motion to quash an indictment on the ground that he was not present at a preliminary hearing.

An information was filed by a police officer before a justice of the peace of Montgomery County charging the defendant John G. O’Brien with armed robbery, burglary and violation of the Firearms Act on August 12, 1953 in that county.

On October 21, 1953 the justice of the peace held a preliminary hearing at which the defendant was not present because he was at the time in jail in Philadelphia County…
