The appellee moves to dismiss this appeal" on the ground that it was not taken within ten days from the date the judgment was signed by the trial court — the judgment having been signed on October 27, 1937, and the motion for appeal filed on November-18, 1937.

An investigation of the record in* the case reveals that the judgment was rendered on October 22, 1937. On October 25,. 1937, two days before the judgment was-, signed, the appellant filed a motion for a new trial, and the court issued its order for the appellee to show cause why a new trial should not be granted.…
