Griffin brought his petition against Obedience Cobb and others, alleging that be was the owner of a lot of land described in the petition,and that Leroy Cobb claimed tobe the owner of the same as the purchaser at a judicial sale. It was alleged that *611•the sale was illegal, for the reason that the execution was dormant, ■and that R. B. Shell, the defendant in the execution under which the sale was had, had no interest in the property as an individual or otherwise at the date of the judgment upon which the execution issued.
