OPINION

By GORMAN, J.

This is an action by a taxpayer to enjoin the city of Cincinnati from issuing bonds for the purpose of carrying out its part of an agreement made on October 8, 1936 with the New York Central Railroad and John A. Jáfeter, director of highways of the state of Ohio.

The subject matter of the contract is lor the elimination of certain grade crossings, which contract was entered into by the city of Cincinnati, Ohio, the New' York Central Railroad and the director of state highways, pursuant to the provisions of §1228-1, GC, the Federal Emergency Relief Appropriation Act of 1935…
