McKAY, Justice.

Appellant brought this suit on a written lease contract with appellee for premises in appellant’s building known as Merchandise Mart in Dallas. The lease was dated January 28, 1964, and was for a term of nine years and five months from May 1, 1964, at the rental rate of $468.66 per month, and appellant alleged appellee breached the contract by vacating the premises and refusing to pay on the lease after December, 1964.
