In an action to recover damages for gross negligence and breach of contract, the plaintiff appeals, as limited by its brief, from so much of an order of the Supreme Court, Queens County (Lonschein, J.), dated May 28, 1996, as, upon reargument, adhered to its determination in an order dated October 13, 1995, granting the defendant’s motion pursuant to CPLR 3211 (a) (7) to dismiss the complaint for failure to state a cause of action.
