BRADY, J.
The appellee, D. M. Baker, who was plaintiff below, and one J. T. Baker were the lessees of about 4,200 acres of land, situated partly in McCulloch and partly in Concho counties, Tex. The lease began April 15, 1910, and ended April 15, 1911, and the land was leased for grazing and pasturage purposes. After acquiring the lease the plaintiff placed in the pastures 393 head of cattle.
