This is an action to set aside a deed, a contract for the purchase of 160 acres of land, and a promissory note executed by the plaintiff on the 20th day of May, 1907. The facts, as shown by the record, are the following in substance: On the 20th day of May, 1907, the plaintiff and defendant met at Donnybrook, Ward county, N. D., and, after certain preliminary negotiations, agreed that the plaintiff would purchase 160 acres of land from the defendant, and that the defendant would purchase two lots in Donnybrook from the plaintiff.
