In this action, plaintiff sought to recover damages suffered by him because of the death of his wife, whose injury and death he alleged were proximately caused by the intoxica tion, gross negligence and willful .misconduct of the defendant, Boland Hoselton. The defendants in their joint answer denied any intoxication, negligence or willful misconduct on the part of Boland Hoselton and alleged contributory negligence on the part of plaintiff’s deceased wife.
