George A. R. Schuster, plaintiff-appellant, brought an action for damages for an alleged breach of a pension or deferred compensation agreement. The case was set for trial on March 31, 1975. The case was called on the morning of that date and counsel for the respective parties appeared. At the beginning of the proceedings defendants filed a motion for summary judgment accompanied by an affidavit.
