This bankruptcy appeal arises from a pre-petition suit filed in the Massachusetts Superior Court by plaintiff-appellants Access Cardiosystems, Inc. (“Access”), four of its individual investors, John J. Moriarty (“Moriarty”), James A. Radley (“Rad-ley”), Richard F. Connolly, Jr. (“Connolly”) and Joseph R. Zimmel (“Zimmel”) (collectively, “the Investors”), and the corporate entities through which several of those investments were made, against defendant-appellant Randall Fincke (“Fincke”), a former Access shareholder, officer and director.
