I. BACKGROUND

This is a case of alleged sexual harassment by a supervisor of his subordinate in the workplace. Katherine Smith filed a three count Amended Complaint against America Online, Inc. (“AOL”) and Chris Britton alleging: 1) Count I — sex discrimination against AOL pursuant to a theory of hostile work environment under Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. § 2000e, et seq.; 2) Count II — the intentional tort of battery against Britton; and 3) Count III — negligent hiring, retention and supervision against AOL.
