Appeal from an order of the Supreme Court (Cerio Jr., J.), entered December 8, 2015 in Madison County, which granted defendants’ motion for summary judgment dismissing the complaint.

Plaintiff Howard F. Jones and his spouse, derivatively, commenced this action seeking to recover for injuries that Jones allegedly sustained on April 1, 2011 when the pick-up truck that he was operating was rear-ended by a van driven by defendant Merrick M.
