MILLIKEN, Chief Justice.

Appellant, Elzie Meredith, was convicted of raping Zelma Carrier, a woman over twenty-one years of age, and sentenced to the penitentiary for life without parole. The verdict was returned June 30, 1955, and the judgment entered the same day.

The regular June term of the Edmonson Circuit Court ended July 2, 1955, the term not having been extended. *707Under Section 273 of our Criminal Code of Practice, the application for a new trial must be made at the same term at which the verdict is rendered unless the judgment he postponed to another term, in which event the motion may…
