This is an income tax refund case. The Plaintiffs are husband and wife and reside in Gladewater, Texas. The years involved are 1959, 1960 and 1961. The Plaintiff, Loyce Phillips, is and during the tax years involved was an independent oil operator with working interests in some 40 to 50 oil and gas wells, about ten of which were located in the Manuel Rionda Survey, Freestone County, near Fairfield, Texas, in the so-called Nan-Su-Gail Field.
