This is a motion by the defendant to dismiss an indictment which was returned against him on the 3d day of June, 1953, charging him with the crime of maintaining a public nuisance. The motion is made upon the ground that the indictment does not contain a plain and concise statement of the acts constituting the crime as required by subdivision 2 of section 275 of the Code of Criminal Procedure.
