In an action to *702recover damages for personal injuries, the defendant Salem Transportation Co., Inc. appeals from an order of the Supreme Court, Queens County (Durante, J.), dated December 22, 1987, which denied its motion for summary judgment dismissing the complaint insofar as it is asserted against it.

Ordered that the order is reversed, on the law, with costs, the motion is granted, the complaint is dismissed insofar as it is asserted against the appellant, and the action against the remaining defendants is severed.
