Currently pending in the above-captioned miscellaneous action is Apollo Group, Inc.’s *15(“Apollo”) [1] Motion to Compel Respondent, the Department of Education (the “DOE”), to produce documents responsive to a subpoena duces tecum pursuant to Federal Rule of Civil Procedure 45 (the “Amended Subpoena”), issued from the United States District Court for the District of Columbia in connection with an underlying securities litigation pending in the District of Arizona.
