Appeal from a judgment of the County Court of Albany County (Harris, J.), rendered February 20, 1986, convicting defendant upon his plea of guilty of the crime of murder in the second degree.

Defendant was indicted on September 13, 1985 in a seven-count indictment arising out of the burglary of the Albany Dodge auto dealership in the City of Albany and the death of Cyril Marshall, the night watchman at Albany Dodge.
