Appellant, as plaintiff, began this action in the court below, seeldng to enjoin the collection of the tax assessed against certain real property-in Thurston county. It is not claimed that the tax is void or that the property taxed is exempt from taxation, but the basis of the action is the alleged gross over-valuation of the property for taxation purposes, resulting in a greatly excessive tax.

It seems to be conceded that the complaint states what would be a cause of action but for chapter 62, Laws of 1931, p. 201, and perhaps one purpose in bringing the suit was to obtain a construction of…
