The defendant was indicted for various counts of murder in the second degree and related charges. The court submitted two counts of murder in the second degree, Penal Law § 125.25 (1) and (3), and one count of robbery in the first degree, Penal Law § 160.15 (3), to the jury. The jury acquitted the defendant of felony murder but convicted him of intentional murder and robbery in the first degree.
