On February 28, 1990, the defendants, Souvanheung Phachansiri (“Souvanheung”), Souvanna Phachansiri (“Souvanna”), and Khambor Phouthongseng (“Khambor”), were indicted for first degree murder (G. L. c. 265, § 1) and kidnapping (G. L. c. 265, § 26).2 Souvanna was also indicted for assault and battery by means of a dangerous weapon (a broken bottle) (G. L. c. 265, § 15A[6]), assault and battery by means of a dangerous weapon (a revolver) (G. L. c. 265, § 15A[b]), and unlawful possession of a firearm (G. L. c. 269, § 10).
