This .was a hill in equity, brought by the plaintiffs, Ellick Powell and Elizabeth, his wife, praying for an assignment of her dower, in certain lauds, now owned by the defendants, and which formerly belonged to one Boswell Merrick, the former husband of the said Elizabeth. The defendants resisted the claim, upon the ground, that the said Elizabeth had legally relinquished and conveyed away her dower in the several parcels of lands described in the bill, by good and sufficient instruments, and that the same are now held by the defendants, free from such incumbrance.

STORY, Circuit Justice.
This is a bill in equity, for an assignment of dower. I pass over, without observation, any defects in the bill and answers, which might raise a question as to the sufficiency and accuracy of the proceedings, because I understand it to be the wish of all the parties to have the case finally adjudged upon the merits, as they have been stated and relied on at the argument There are various parcels of land, of which dower is claimed, and it is conceded on all sides, that as to one parcel, designated as lot No. 7, which was conveyed in 1S12 by La vina Utloy to Iloswell…
