This is an appeal from a judgment of the county court, overruling the appellant Rochester Haddaway’s plea of privilege to be sued in the county of his residence. The appellee, Burford, brought the suit in the county court of Lubbock county, alleging that appellant and himself made and entered into a certain written contract whereby appellant agreed to sell to appellee certain real estate situated in the county of Bailey, state of Texas, for a consideration of $1,485.60; that at the time of executing said contract appellee paid the appellant the.sum of $371.40, and agreed to pay on the 1st day…
