Donna Heffernan brought this action in the Superior Court against the Wollaston Credit Union (the credit union) alleging that the credit union converted funds from a passbook account standing in her name. A former joint owner of the account had received a loan from the credit union and died before the loan became due or was repaid. The issues, tried without jury, were, first, whether a valid security interest in favor of the credit union in the disputed portion of the account was created by the former joint owner in connection with the loan and, second, whether Heffernan obtained ownership of…
