ORDER

BROOKS, Chief Judge.

This matter is before the Court upon the motion of the defendant, AMF, Ind. (“AMF”), to strike and for judgment on the pleadings on Count III of plaintiffs complaint, pursuant to Rule 12 of the Federal Rules of Civil Procedure. The Court, having held oral argument in this matter and having received all the necessary briefs, notes the matter ripe for ruling. Jurisdiction is properly asserted under the provisions of 28 U.S.C. § 1331.
