Appellant, Alfred Luongo, seeks reversal of the July 6, 2012 Order of the Tulalip Tribal Court in which the Tribal Court ordered that a 2008 Ford Econoline Van owned by Appellant be forfeited to the Tulalip Tribes (hereinafter also “Appel-lee”) under the civil forfeiture provisions of Chapter 2,15 of the Tulalip Tribal Code. This Court holds that the excessive fines clause of the Indian Civil Rights Act applies to civil forfeitures under Chapter 2.15, and we remand this matter to the Tribal Court for a determination of whether the forfeiture of Appellant’s van constitutes an excessive fine in…
