— This cause is pending before the Court on the appellee’s Motion to Dismiss Appeal, which alleges as cause therefor that the record herein is defective in that it does not contain a transcript of the proceedings at trial, nor a statement of the evidence or proceedings when the transcript is unavailable, as provided for by Rule AP. 7.2(A) (3) (c), nor a statement of the case as provided for by Rule AP. 7.3.
