An action in trespass was brought by Matilda Jaca-mino, mother of Frank Jacamino, to recover damages for the death of her son, who was accidentally killed while assisting in unloading one of defendant’s trucks, then in charge of its servant.
Defendant is a corporation engaged in the business of transporting freight by motor truck, and having its office in Newark, N. J. On a number of occasions previous to September 30, 1936, the day of the fatal accident, one of its drivers, Boutilette, had hauled loads of empty storage battery cases, each weighing about twelve pounds…
