Error to the Court of Civil Appeals for the Second District, in an appeal from Potter County. Sanborn brought suit to recover land, appealed from a judgment for defendants, and on its affirmance obtained writ of error.

Plaintiff in error brought this suit to recover of defendants in error the west half of block 352 of the Mirror addition to the town of Amarillo, and lost in the trial court and in the Court of Civil Appeals on the ground that the action was barred by the four years statute of limitation. His original petition sought to recover the property upon the allegation of title, as is usual in trespass to try title.
