— Appeal from a judgment of the County Court of Chemung County (Monroe, J.), rendered May 31, 1983, convicting defendant upon his plea of guilty of the crime of assault in the first degree. H Around 3:00 a.m. on July 3,1982, defendant became involved in an altercation on the lawn in front of his ex-wife’s home in the Village of Horseheads, Chemung County. Without any apparent provocation, he struck her brother and her boyfriend with a baseball bat and then proceeded to strike his ex-wife with the bat several times in the head.
