The Appellant, William Orville Cole, hereinafter referred to as defendant, was charged and tried, after waiving his right to counsel and to a jury trial, in the District Court of Oklahoma County, for Assault with a Deadly Weapon, Case No. CRF-76-154. After submission of all evidence, the trial court found the defendant guilty of the lesser included offense of Assault and Battery With a Dangerous Weapon.
