On November 19,1960, the defendant was arraigned on a charge of leaving the scene of an accident in violation of section 600 of the Vehicle and Traffic Law, and reckless driving in violation of section 1190 of the same law, alleged to have been committed on the 28th of October, 1960.

On January 5, 1961, the defendant was convicted following a jury trial, on the testimony of the witnesses and the evidence, of the crime of leaving the scene of an accident in violating section 600 of the Vehicle and Traffic Law, and he was acquitted by the jury on a charge of reckless driving under section 1190…
