UDALL, Justice.

Defendant appeals from a judgment of the Superior Court of Yuma County for plaintiff Tommy G. Bowman in the amount of $5,294. :

For the purposes of this appeal the important facts are as follows: Defendant, in the business of buying and selling cattle, maintained eight pens or corrals on two and one half to three acres of land adjacent to the railroad tracks seven miles east of Yuma, Arizona.
