In Re Hathaway

Michigan Supreme Court

Decided July 10, 2001No. Docket 112495Published

1DissentCavanagh, J.

With its decision in this case, this Court departs from thirty-three years of precedent to assert that it has the constitutional authority to impose a level of discipline that exceeds the discipline recommended by the Judicial Tenure Commission. It does so in a matter that the jtc has . twice considered and in which twice a unanimous jtc and the respondent Judge Hathaway have agreed on the *698appropriate level of discipline. I do not believe that this Court has the constitutional authority to increase the discipline recommended by the JTC and, accordingly, I must respectfully dissent.
