Charles Kitchen,- Sr., a citizen and resident of Carter county, died testate in the latter part of 1923. After his will had been duly probated in the county court of that county, James H. Kitchen, John W. Kitchen, and Charles J. Kitchen, Jr., who were nominated as .executors therein, were duly appointed and qualified as such. Charles J.
