Plaintiff-Appellant Sierra Club appeals from the district court’s decision granting summary judgment in favor of Defendants-Appellees United States Forest Service (“USFS”) and Enbridge Energy Limited Partnership (“Enbridge”). Sierra Club argues that the USFS violated the National Environmental Policy Act (“NEPA”), 42 U.S.C. § 4332(2)(C), in failing to prepare an Environmental Impact Statement (“EIS”) or an Environmental Assessment (“EA”) prior to reissuing a permit to En-bridge to operate and maintain an oil pipeline on federal land.
