The defendant was initially charged with violating Penal Law §265.02 (criminal possession of a weapon in the third degree), a class D felony, and with various violations of the Administrative Code of the City of New York, including violation of section 10-131 (h) (2) (unlawful possession of a loaded shotgun). The charges were presented to the Grand Jury of Bronx County and the defendant was indicted on one count of criminal possession of a weapon in the third degree and one count of unlawful possession of a loaded shotgun.
