SUTTON, Justice.

The appellee, as plaintiff, sued the appellant to recover for personal injuries sustained by him at the intersection of Alame-da Avenue and Hammett Boulevard on September 2, 1945, in a collision between himself and a street car operated by the defendant. The trial was in the 41st District Court of El Paso County to a jury on the 'facts and on a favorable verdict judgment was rendered in favor of plaintiff in the sum of $10,000. From that judgment the defendant has appealed.
