In this en banc review, we must determine to what extent our earlier decision in Patriot Party of Allegheny County v. Allegheny County Dep’t of Elections, 95 F.3d 253 (3d Cir.1996) (Patriot Party I), remains good law in the wake of the Supreme Court’s decision in Timmons v. Twin Cities Area, New Party, 520 U.S. 351, 117 S.Ct. 1364, 137 L.Ed.2d 589 (1997).
