Appeal from a judgment of the Appellate Division of the Supreme Court in the third judicial department, entered January 6, 1913, affirming an interlocutory judgment of Special Term in an action for the partition of real property. 1Opinion of the CourtHiscock, J.

This action was brought for the partition of certain real estate situate in the city of Albany. The respondent claims that it is seized and owner of one-third of said real estate under the residuary clause of the will of one Lathrop who concededly died seized of said property. The appellants, who are respectively the niece and grandniece of said testator, dispute this claim and allege that the title to said property passed to the heirs of said testator of whom they are two.
