Appeal from a judgment of the County Court of Broome County (Mathews, J.), rendered July 31, 1997, convicting defendant upon his plea of guilty of the crime of murder in the second degree.

Defendant and a codefendant were indicted of the crimes of murder in the second degree and two counts of robbery in the first degree following an incident in which property was taken from the home of a 70-year-old man in the Town of Chenango, Broome County, and his throat was slit, eventually resulting in his death.
