Appeal from an order of the Family Court of Tioga County (Sgueglia, J.), entered August 20, 1996, which, inter alia, dismissed petitioner’s application, in a proceeding pursuant to Family Court Act article 6, to modify a prior order of custody.
Petitioner and respondent, who never married, had two children, Matthew, born in 1988, and Alexander, born in 1992. Following their separation in 1993, petitioner was granted custody of the children and respondent exercised visitation.
